About Naina Kapur

As a pioneer in establishing the prevention of sexual harassment at all workplaces, Naina Kapur framed and acted as lead instructing counsel before the Supreme Court of India in 1997 which resulted in legally binding directions on workplace sexual harassment. Considered a landmark judgement in national and international jurisprudence. Vishaka v State of Rajasthan has been recognised as a leap in domestic application of International law and Constitutional gender equality in India. With the passing of the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013 she is actively pursuing compliance, prevention, mediation and redress at workplaces.

Naina is passionate about helping workplaces and institutions arrive at safe, healthy and inclusive options through enabling and skillful compliance with equality norms and practices. Her extensive work with equality and non-discrimination have benefited clients who have companies in accountancy, software, cosmetics, banking, telecommunications, hotels, transportation, civil society, paint, finance and education. They also include professionals, individuals and government sector departments.

Prior to forming a virtual law practice, Naina has various professional experiences in the private and public sector where she has handled all kinds of legal matters.  As a Civil Society leader, she has accumulated expertise in  equality and non-discrimination compliance through innovative training  processes. That expertise has enabled her to provide visionary solutions to everyday legal needs for her clients with a goal to resolve conflicts/issues before they go to court. Recently Naina has become an accredited Mediator of the Indian Institute of Arbitration & Mediation (IIAM)

Innovative approaches and leadership have been her hallmark in test case litigation, workplace investigations on sexual and other forms of harassment and bullying as well as law and policy reform. She founded and designed  a unique Asia-Pacific judge/ngo partnership on judicial education on Equality issues, which have fine tuned her skills as an expert facilitator and trainor.  A proficient public speaker and presenter, Naina has enrolled national and international audiences into the value and practice of equality and social context thinking. Characterised by an inclusive approach, Naina’s work has found creative expression in numerous publications.
