About Us
Our Background
Having successfully brought a public interest litigation before the Supreme Court of India in Vishaka v State of Rajasthan on workplace gender equality and sexual harassment, Naina Kapur (Advocate) is a pioneer and specialist in the field. The Vishaka directions, as they are known have been amplified through Central Government legislation in 2013 i.e. The Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act. Private and public workplaces have been served with a legal obligation to prevent and resolve unwelcome and unhealthy workplace conduct that amounts to sexual harassment or hostile workplace environment.
That includes putting in place
- effective user-friendly policies/documentation
- preventive know-how and practices
- workplace orientation and education and
- an internal complaints committee that is skilled and capable
- skillful & accurate reporting
- third party expertise for internal complaint committees
With nearly 20 years of experience on equality issues, at NKL we are committed to providing workplace employers, management and human resource departments, civil society organisations and individuals with the appropriate know-how, compliance procedures and equality practices to respond effectively to discriminatory conduct and workplace sexual harassment through comprehensive expert legal know-how and specialist creative training.
Our goal is to provide an integrated and holistic response to the demand for accessible expertise regarding equality and non-discriminatory workplace policies and practices. With the advent of International norms and standards for safe, healthy and inclusive workplaces, that demand has increased substantially. Expertise in this area is however limited in India and rarely relied upon. That vacuum can lead to serious consequences including, harmful workplace practices, unhealthy workplace environments, costly litigation, high turnover, lost performance and increased production costs.
